1 General provisions
1-1 Acceptance of the general conditions
The customer declares that he/she has read the general terms and conditions of sale and has accepted them without reservation before placing an order.
The customer will not be able to place an order unless he/she ticks the box provided for this purpose.
E.ZICOM reserves the right to adapt or modify these general terms of sale at any time. In this case, only the general terms and conditions of sale in force at the time the order was placed shall apply.
The customer has the possibility to print out these general terms and conditions of sale.
1-2 Purpose
The present general conditions of sale establish the contractual conditions exclusively applicable to any purchase made on the E.ZICOM website by any buyer who is a consumer.
1-3 Identifiers
Connection identifiers are generated at the time of the first order to enable the customer to confirm and fill in the information required to process the order, and then to access their personal space on the site. These identifiers are personal and confidential. They must not be communicated to any third party.
This step assumes that the customer who registers has the legal capacity to order or has a mandate if acting on behalf of a legal person.
2 Pre-contractual information
Article L. 111-1, 5º of the Consumer Code
"Information on legal guarantees, the existence of such guarantees and how they can be implemented
Article R. 111-1, 3º of the Consumer Code
For the purposes of Article L. 111-1(5), the trader shall provide the consumer with the following information:
"If applicable, the existence and the terms of exercise of the legal guarantee of conformity mentioned in articles L. 217-4 to L. 217-13 of the present code and that of the defects of the thing sold under the conditions provided for in articles 1641 to 1648 and 2232 of the civil code as well as, if applicable, the commercial guarantee and after-sales service within the meaning of articles L. 217-15 and L. 217-17 of the present code respectively.
"The general terms and conditions of sale applicable to consumer contracts shall state :
Article L. 211-2 of the Consumer Code
1º According to the methods fixed by decree of the minister in charge of the economy, the existence, the conditions of implementation and the contents of the legal guarantee of conformity and the guarantee relating to the defects of the sold thing, due by the salesman;
2º If applicable, the existence of a commercial guarantee and service."
Order of 18 December 2014 on the information contained in the general terms and conditions of sale concerning legal guarantees
"Art. 1 - Pursuant to Article L. 133-3 of the Consumer Code, the general conditions of sale of consumer contracts must include the name and address of the seller guaranteeing the conformity of the goods to the contract, allowing the consumer to make a request under the legal guarantee of conformity provided for in Articles L. 211-4 et seq. of the Consumer Code or the guarantee of defects in the thing sold within the meaning of Articles 1641 et seq.
Art. 2 - The general conditions of sale of consumer contracts mention that the seller is liable for defects in conformity of the goods with the contract under the conditions of article L. 211-4 and following of the Consumer Code and for hidden defects in the thing sold under the conditions provided for in articles 1641 and following of the Civil Code.
Art. 3 - The general terms and conditions of sale of consumer contracts shall include in a box the particulars according to which, when acting under the legal guarantee of conformity, the consumer :
- has a period of two years from the delivery of the property to act;
- may choose between repairing or replacing the goods, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code;
- is exempt from proving the existence of the lack of conformity of the goods during the six months following the delivery of the goods. This period is extended to twenty-four months from March 18, 2016, except for second-hand goods. This same box reminds us that the legal guarantee of conformity applies independently of any commercial guarantee that may have been granted. It recalls that the consumer may decide to implement the warranty against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and that in this case, he can choose between the resolution of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.
Sec. 4-This order shall become effective on March 1, 2015.
Art. 5 - The Director General of Competition, Consumer Affairs and Fraud Control is responsible for the execution of this order, which will be published in the Official Journal of the French Republic.

3 Controls
3-1 Terms and conditions
To place an order, the customer makes his choice on the website www.eziclean.com and then fills out the order form online under his sole responsibility by specifying all the information requested. The automatic recording systems are considered as proof of the nature, content and date of the order.
In order to place an order, customers will be able to select one or more items and add them to their basket. When their order is complete, they can access their basket by clicking on the button provided.
The availability of products is indicated on the site, in the description of each article.
By consulting their basket, customers will be able to check the number and nature of the items they have chosen and will be able to check their unit price as well as the total price of the order. They will be able to remove one or more items from their basket. If they are satisfied with their order and wish to validate it, customers can click on the validate button. They will then be taken to a form in which they can either enter their login details if they already have them, or register on the site by filling in the form presented to them, with their personal information.
Once logged in or after having completed the form, customers will be invited to check or modify their delivery and billing details and will be informed that their purchase will only be validated after payment of the chosen items. They will then be invited to make their payment by being redirected to the secure payment interface.
Once the payment has been received by E.ZICOM, the latter undertakes to send the customer an e-mail summarising the order and confirming that it has been processed, including all information relating to the order, the products ordered and their delivery. The sale will then be deemed concluded.
E.ZICOM reserves the right to cancel any order from a Customer with whom there is a dispute over payment of a previous order.
The information provided by the buyer when placing an order is binding. In the event of a data entry error, E.ZICOM shall not be held responsible for the consequences in terms of delay or impossibility of delivery. All costs related to the reshipment of the products due to an error in the customer's entry shall be borne exclusively by the customer.
Orders can only be placed through the website www.eziclean.com or other partner websites.
All orders placed on the website www.eziclean.com are intended for the personal use of customers or recipients of products. Any partial or total resale of the products is forbidden.
Promotional codes cannot be combined with current offers.
Any commercial offers only apply if they are expressly specified on the site on the date of the order and subject to compliance with the conditions. They cannot be combined with each other.
3-2 Order modification
Modification of the order by the buyer :
As orders are final and irrevocable, any request for modification made by the buyer is subject to acceptance by the seller.
Modification of the order by the seller :
The seller is obliged to deliver a product that conforms to the one ordered.
If the product ordered is unavailable, the seller shall offer the consumer, who must agree, the supply of an equivalent product to replace the product ordered.
If the customer does not agree, the unavailability of the product ordered will result in the cancellation of the order and the reimbursement of the consumer.
The seller may only make changes to the ordered product that are related to technical developments under the conditions set out in Article R. 212-4, paragraph 4 of the Consumer Code with the express agreement of the customer.
3-3 Validity of the order
The seller reserves the right to refuse any order for legitimate reasons and more particularly in the event that the quantities ordered are abnormally high compared to the quantities usually ordered by buyers in their capacity as consumers or in the case of a Customer with whom there is a dispute relating to the payment of a previous order.
In the event of a data entry error, E.ZICOM shall not be held responsible for the consequences in terms of delay or impossibility of delivery. All costs related to the reshipment of products due to an error in the customer's entry shall be borne exclusively by the customer.
3-4 Withdrawal period
In accordance with articles L.221-18 et seq. of the French Commercial Code, the consumer has a period of fourteen clear days to exercise his or her right of withdrawal without having to justify his or her reasons or pay any penalties, with the exception, where applicable, of the cost of returning the goods.
The fourteen-day period shall begin from the day on which the consumer or a third party, other than the carrier, designated by the consumer, receives the goods in the case of contracts for the sale of goods. For off-premises contracts, the consumer may exercise his right of withdrawal from the time of conclusion of the contract.
In the case of an order for several goods delivered separately or in the case of an order for a good composed of multiple lots or parts whose delivery is staggered over a defined period of time, the time limit shall run from the receipt of the last good or lot or part.
For contracts providing for regular delivery of goods during a specified period, the period runs from the time of receipt of the first goods.

The company E.ZICOM will then send all the return details by email within 48 to 72 hours.
If the customer can be held liable for any depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods, E.ZICOM may bring an action before the competent courts to invalidate this right of withdrawal. The customer shall handle and inspect the item during the withdrawal period with all due care.
In case of exercising the right of withdrawal within the above-mentioned period, only the price of the product(s) purchased and the shipping costs will be reimbursed, the return costs remaining at the customer's expense. Products must be returned in their original condition and complete (packaging, accessories, instructions, etc.) so that they can be remarketed in new condition; they must be accompanied by a copy of the purchase receipt.
Refund procedure: No later than 14 days from the date on which E.ZICOM receives the goods to be refunded or 14 days from the date on which customer provides proof of shipment of the goods (whichever is earlier), E.ZICOM shall refund customer using the same method of payment that customer used for the original transaction, unless customer expressly agrees to the use of another method of payment and provided that the refund does not incur any costs to customer.
3-5 Termination or cancellation of the order
The order may be cancelled by the buyer by registered letter with acknowledgement of receipt sent to E.ZICOM at the following address 46-48 RUE GAY LUSSAC 94430 CHENNEVIERES SUR MARNE in the event of :
- delivery of a product that does not conform to the declared characteristics of the product;
- The seller shall not be obliged to deliver beyond the deadline set in the order form or, in the absence of such a deadline, within thirty days of the conclusion of the contract, after the seller has been requested, in the same way and without result, to deliver within a reasonable additional period.
- price increase that is not justified by a technical change in the product imposed by the government.
The order can be cancelled by the seller in case of :
- refusal of the buyer to take delivery;
- of non-payment of the price.
4 Products
4-1 Product characteristics
The customer may, prior to placing an order, take note of the essential characteristics of the products he/she wishes to order by consulting the pre-contractual information communicated to him/her by the seller on the E.ZICOM website.
4-2 Stock availability
Products are offered and delivered while stocks last.
In the event of unavailability of the product ordered, the seller shall immediately inform the buyer and may offer him a product of an equivalent quality and price or, failing that, a voucher for the amount of the order to be used for any future order.
If the buyer does not agree, the seller shall refund the sums paid within 30 days.
Apart from the reimbursement of the price of the unavailable product, the seller is not obliged to pay any compensation for cancellation, unless the non-performance of the contract is personally attributable to him.
5 Awards
5-1 Sales prices
The prices of the products offered for sale by the company E.ZICOM are indicated in Euros on the site, all taxes included, excluding the cost of processing and shipping, and are valid as long as they are present on the screen.
All orders are payable in Euros.
E.ZICOM reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time of the recording of the orders, subject to availability on this date.
The products remain the property of E.ZICOM until full payment has been received by E.ZICOM.
Any commercial offers only apply if they are expressly specified on the site on the date of the order and subject to compliance with the conditions. They cannot be combined with each other.
5-2 Delivery and collection costs
The additional costs of transport, delivery or postage (to which must be added any other costs borne by the seller), of which the customer is aware before ordering, appear, according to the choice made by the customer, in the order summary before payment as additional costs added to the price of the product or products ordered.
For all orders under 50,00€, shipping costs to France (and Corsica) are :

For all orders placed to European countries and others, shipping costs are managed by our DPD carrier. A simulation is proposed before placing an order.
The customer must always check the package upon arrival. It is strongly advised to make a Reservation upon receipt of the package to the Carrier.
No deliveries can be made via P.O. Box, P.O. Box, C.O.D. or Poste Restante.
For reasons of availability, an order can be delivered to the customer in several instalments. In this case, the customer only pays for one delivery. If the customer wishes to have two deliveries, he/she places two orders, with the associated delivery costs.
In the case of a technical product, the customer must take particular care to check the correct operation of the appliance delivered and to read the user's manual provided. In the event of apparent defects, the purchaser benefits from the right of return under the conditions provided in this document.
5-3 Price changes
The seller reserves the right to modify its prices at any time, in particular in the event of an increase in costs, it being understood that, in the event of a price increase subsequent to the order, only the price fixed on the day of this order will be applicable to the customer.
In the event of a price increase due to the application of the price list in force on the day of delivery, the buyer has the right to cancel the order.
6 Payment of the price
The price invoiced to the customer is the price indicated on the confirmation of order addressed by E.ZICOM.The price of the products is payable, in Euros, in cash, the day of the effective order.
6-1 Methods of payment
Payment for purchases can be made by credit card, using the secure online payment solutions MERCANET, PayPal or STRIPE .
The order validated by the customer will only be considered effective when the bank payment centres concerned have given their agreement. In the event of refusal by the said centres, the order shall be automatically cancelled. Furthermore, E.ZICOM reserves the right to refuse any order from a customer with whom a dispute exists.
The BNP bank allows customers to pay online via its bank server in a secure environment, so the customer's credit card number is directed to the bank's servers. The payment of the customers is carried out directly with a bank in a completely protected and encrypted environment, without passing by the waiter of the store, guarantee all the more important as the N° are known only of the banking partner of E.ZICOM (BNP - MERCANET).
6-2 Retention of title clause
The seller remains the owner of the products sold until the price has been paid in full and the buyer undertakes, until ownership is transferred to him, to take all useful precautions for the proper conservation of the products.
7 Delivery
7-1 Definition
Delivery means the transfer to the consumer of physical possession or control of the goods.
7-2 Delivery time
The products shall be delivered on the date or within the period indicated by E.ZICOM at the time of the order.
In the absence of any indication as to the date of delivery or performance of the services, the seller undertakes in any event to deliver the products or provide the services within 7 working days of the order.
7-3 Delay in delivery
If the product ordered is not delivered or the service is not provided on the date or at the end of the period mentioned on the day of the order validated by the payment, the consumer may, after unsuccessfully requesting the seller to fulfil his obligation to deliver within a reasonable additional period, rescind the contract by registered letter with acknowledgement of receipt or by a written document on another durable medium
7-4 Place of delivery
The products are delivered to the address indicated by the customer.
7-5 Terms of delivery
Delivery shall be made by handing over the product directly to the buyer or, failing that, by the seller sending a notice of availability to the buyer.
Within fifteen days of the notice of availability, the buyer must withdraw the ordered product.
If the goods are not collected within the period indicated, the seller may, after a formal notice from the buyer, which has remained without effect, proceed with collection and automatically cancel the order.
When the product is delivered to the address indicated on the order form by a carrier, it is the buyer's responsibility to check the condition of the delivered product in the presence of the delivery person and, in the event of damage or missing items, to express reservations on the delivery note or the transport receipt, and possibly to refuse the product and inform the seller.
7-6 Delivery and transfer of risk
The risk of loss of or damage to the goods shall pass to the customer at the time when the customer or a third party designated by the customer other than the carrier designated by E.ZICOM takes physical possession of the goods.
7-7 Spare parts
E.ZICOM guarantees the consumer the storage and availability of spare parts for the goods sold for a minimum period of 3 years following the purchase of the product.
Articles L. 111-4 and D. 111-4 of the Consumer Code :
"The seller shall confirm to the consumer at the time of purchase of the goods, on the order form or the general terms and conditions of sale or on any other durable medium, the information which he has already given as pre-contractual information and which has been delivered to him by the manufacturer or importer of movable goods concerning the period during which, or the date up to which, spare parts essential for the use of a good are available."
8 Compliance
The seller undertakes to supply goods that comply with the legal requirements in force and the contractual requirements.
9 Legal guarantee of conformity
9-1 Consumer information
Article L. 111-1, 4º of the Consumer Code:
"Before the consumer is bound by a contract for the sale of goods or provision of services, the trader shall provide the consumer with the following information in a legible and comprehensible manner
4º Information relating to the existence and implementation of guarantees and other contractual conditions. The list and precise content of this information shall be determined by decree of the Council of State.
Article R. 111-1, c) of the Consumer Code :
"For the purposes of applying Article L. 111-1(4), the trader shall provide the consumer with the following information:
c) If applicable, the existence and terms of exercise of the legal guarantee of conformity mentioned in articles L. 217-4 to L. 217-14 of this code and that of defects in the thing sold under the conditions provided for in articles 1641 to 1648 and 2232 of the civil code as well as, where applicable, the commercial guarantee and after-sales service within the meaning of articles L. 217-15 and L. 217-17 of this code respectively.
Article L. 211-2 of the Consumer Code :
"The general terms and conditions of sale applicable to consumer contracts shall state :
1º According to the methods fixed by decree of the minister in charge of the economy, the existence, the conditions of implementation and the contents of the legal guarantee of conformity and the guarantee relating to the defects of the sold thing, due by the salesman;
2º If applicable, the existence of a commercial guarantee and after-sales service.
Independently of any commercial guarantee that may have been granted, the seller is liable for defects in the conformity of the goods that are the subject of the contract under the conditions of Article L. 217-4 et seq. of the French Consumer Code and for hidden defects in the goods sold under the conditions set out in Articles 1641 et seq. of the French Civil Code.
In accordance with the law, E.ZICOM assumes two guarantees: of conformity and relative to the hidden defects of the products. E.ZICOM shall reimburse the purchaser or exchange products that appear to be defective or that do not correspond to the order placed.
The products of E.ZICOM are covered by the legal guarantee of 24 months.
In accordance with the law, the company E.ZICOM assumes a legal guarantee of conformity. It lasts for 24 months from the delivery of the goods.
The legal guarantee of conformity may be invoked by the consumer if:
The good is unfit for the use usually expected of a similar good;It does not correspond to the description given by the seller;It does not have the qualities that a buyer may legitimately expect in view of the public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling;It does not have the characteristics defined by mutual agreement by the parties;It is unsuitable for any special use sought by the buyer, brought to the attention of the seller and that the latter has accepted.
It is recalled that the legal guarantee of conformity does not apply if :
The customer was aware of the defect at the time of purchase;The customer could not have been unaware of the defect at the time of purchase;The defect results from materials supplied or added by the customer.
The following are notably excluded from the warranty damage resulting from non-compliance with the instructions for use of the products, normal wear and tear of the products, poor maintenance, accidental damage or damage resulting from abnormal use of the products, an error on the part of the client, his client or users of the equipment or a failure on their part to perform basic operations of use; those resulting from the use on the equipment or installation of products other than those recommended by the manufacturer; those originating from a cause external to the equipment or installation or their accessories (in particular, blows, shocks, breakage, clearing, oxidation, falls, fires, scratches, etc.); those corresponding to progressive wear and tear of the equipment or installation.); those corresponding to normal progressive wear and tear of the equipment or its accessories requiring their replacement; those at the origin of which or for the repair of which third parties not approved by E.ZICOM or by the manufacturer intervened during the warranty period.

* Processing fees
* Processing within 21 working days (5 days on average)
For any request of return after sales service, the customers coming from the DOM-TOM will see their forwarding costs, by the Colissimo Service (only), refunded by E.ZICOM.In the event of breakdown not covered by the guarantee, or sending of a file of assumption of responsibility after sales service with missing administrative parts, an estimate of an amount of 99,00€ including all taxes will be sent to the customer. If it should be refused, the device will be returned after reception of the copy of the refused estimate signed and of a payment of 32,00€ TTC for administration, storage and product return.
The seller recalls that :
the customer has a period of two years from the delivery of the good to act with the seller, which he can choose between replacement and repair of the good. The customer can also be refunded in full (by returning the product) or partially (by keeping the product) if these two options are impossible, cannot be implemented within one month of the customer's complaint or create a major inconvenience.that he is exempted from bringing the proof of the existence of the defect of conformity of the good during two years for the new goods and six months for the second-hand goods, that the customer can also make claim to the guarantee against the hidden defects of the sold thing within the meaning of the article 1640 of the civil code and in this hypothesis he can choose between the resolution of the sale or a reduction of the selling price.
9-2 Implementation of the conformity guarantee
Article L. 217-4 of the Consumer Code :
"The seller is obliged to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.
He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility.
Article L. 217-5 of the Consumer Code:
"The property is in conformity with the contract:
(1) whether it is fit for the purpose ordinarily expected of similar property and, if so
- if it corresponds to the description given by the seller and has the qualities that the seller has presented to the buyer in the form of a sample or model;
- if it has the qualities that a purchaser may legitimately expect, having regard to the public statements made by the seller, the producer or his representative, particularly in advertising or labelling;
2º Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.
Article L. 217-6 of the Consumer Code:
The seller shall not be bound by the public statements of the producer or his representative if it is established that he did not know them and was not legitimately in a position to know them.
Article L. 217-7 of the Consumer Code:
Defects of conformity that appear within twenty-four months from the date of delivery
10 Warranty for hidden defects
Article 1641 of the Civil Code:
"The seller is bound by the guarantee for hidden defects in the thing sold which render it unfit for the use for which it was intended, or which so diminish that use that the buyer would not have acquired it, or would only have given a lower price for it, if he had known about them.
Article 1648 of the Civil Code:
"The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
The customer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code.
In this case, he can choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.
11 Commercial guarantee
11-1 Consumer information
Independently of the commercial guarantee, the seller remains bound by the legal guarantee of conformity mentioned in articles L. 217-4 to L. 217-12 of the present code and that relating to defects in the thing sold, under the conditions provided for in articles 1641 to 1648 and 2232 of the civil code.
11-2 Definition of the commercial guarantee
E.ZICOM offers its customers a 1-year commercial warranty that starts the day after the last day of the 2-year legal warranty. In order to benefit from this 1 year commercial warranty extension, it is necessary to register your product on the website www.eziclean.com in the "PRODUCT REGISTRATION" section and to accept the terms of the warranty extension contract. This commercial warranty must be activated within a maximum of 3 months following the purchase of the product (invoice date as proof) on the manufacturer's website. After this period, the subscription to this commercial warranty will no longer be possible.

Article L. 217-15 of the Consumer Code :
"A commercial guarantee is any contractual commitment by a trader to the consumer to reimburse the purchase price, replace or repair the goods, in addition to his legal obligations to ensure the conformity of the goods.
11-3 Guarantee contract
Article L. 217-15 of the Consumer Code :
"The commercial guarantee shall be the subject of a written contract, a copy of which shall be given to the buyer.
The contract shall specify the content of the guarantee, the terms of its implementation, its price, its duration, its territorial scope and the name and address of the guarantor and shall reproduce Article L. 211-16.
11-4 Purpose and conditions of the guarantee
The seller undertakes to repair or replace the sold product under certain conditions if a defect appears within 1 year after the end of the legal guarantee period.
11-5 Product downtime due to repair

12- Breakdown on unpacking
This procedure applies to a failure that has occurred and has been reported to E.ZICOM or its reseller partner within 10 days of the date of invoicing of the product and/or receipt.
In order to meet the requirements of the Customer, E.ZICOM will ensure the shipment of a new replacement product subject to compliance with the conditions set out in the "Support Form". This form will be sent to the Customer after he/she has contacted E.ZICOM and confirmed the opening of a file for unpacking failure from his/her secure customer area, by e-mail or by telephone.
13 Liability, force majeure, penalty clause
13-1 Exemption from liability and force majeure
The seller cannot be held liable in the event of non-performance or poor performance of the contract due either to the fault of the buyer, or to the insurmountable and unforeseeable act of a third party to the contract, or to a case of force majeure.
13-2 Penalty clause
In all cases of non-performance of its obligations by the buyer, the deposit paid at the time of the order shall be retained by the seller as compensation.
14 Resolutive clause

19 Information on the return and collection of waste electrical and electronic equipment
Electrical and electronic equipment that has reached the end of its life cycle, is obsolete or no longer functional must not be thrown away in the rubbish bin or in the selective sorting bins of its municipality, in application of decree n°2020-1455 of 27 November 2020. Article R541-161
If the sale takes place in a shop and without delivery, the used products are taken back at the place of sale or in the immediate vicinity.
When the sale is carried out with a delivery, the return of used products is carried out at the point of delivery, or at a local collection point that the distributor finances and organises or arranges for when it concerns products that can be transported without equipment, or by providing a return solution at no cost to the holder such as a postal service or equivalent when the characteristics of the used products allow it. The used product can be returned directly to a waste prevention or management operator under contract with an approved eco-organisation for this product category, where this is offered.

The take-back obligation provided for in II of Article L. 541-10-8 shall apply within the limit of products of equivalent nature and dimensions that are offered for sale by the distributor.
When the distributor temporarily offers products for sale, he is not obliged to take back used products as provided for in II of Article L. 541-10-8 outside the periods of sale.
